Current Regulations Governing Coal Combustion By-Products - South Carolina

Under South Carolina regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste. Regulations authorizing reuse of CCBs were drafted in 1994 by the South Carolina Department of Health and Environmental Control (SCDHEC), but have reportedly been abandoned. According to SCDHEC, it may proceed instead with reuse regulations for all industrial solid wastes, including CCBs.

Detailed Review of CCB Regulations:
Under South Carolina regulations, fly ash, bottom ash, slag and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste. S.C. CODE REGS. 161-79.261.4. CCPs are regulated in South Carolina as industrial solid waste when disposed in landfills. S.C. CODE REGS 61-107.16.

Regulations authorizing reuse of CCPs were initially drafted in 1994 by the South Carolina Department of Health and Environmental Control ("SCDHEC"). The proposed draft rule defined CCPs to include fly ash, bottom ash, boiler slag, and flue gas desulfurization residue produced by coal fired electrical or steam generation units, which are used in a manner considered beneficial and specified several beneficial reuse activities. However, according to the SCDHEC, it has withdrawn the draft rule and will not allow sources to rely upon it for beneficial use projects; however, the SCDHEC will review proposals on a case by case basis.
