Current Regulations Governing Coal Combustion By-Products - New Mexico

Under New Mexico regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste and solid waste. CCBs may be considered industrial solid waste. Reuse of CCBs is not specifically authorized under New Mexico law, but CCBs have been reused in cinder blocks and other applications.

Detailed Review of CCB Regulations:
Under New Mexico law, fly ash, bottom ash, slag and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous and solid waste. N.M.Code 74-4-3(I)(2); N.M.Code 74-9-3(N)(2); N.M.Reg. 20-9-1-1-105(I).

Currently, reuse of CCPs is not specifically authorized under New Mexico law or regulations. According to the New Mexico Environment Department, CCPs are reused in cinder blocks and other applications.
