Under Mississippi regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste. Reuse of CCBs is not specifically authorized under Mississippi law.

Detailed Review of CCB Regulations:
Mississippi regulations adopt by reference the federal regulation which exempts CCPs from classification as hazardous waste. Exempt from hazardous waste regulation are fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal. MISS. REG. PART 261; 40 CFR 261.4. Coal ash and coal combustion byproducts are generally regulated as industrial solid wastes in the State of Mississippi under the provisions of the Mississippi Nonhazardous Waste Management Regulations. Currently, reuse of CCPs is not specifically authorized under Mississippi law or regulations, however projects may be authorized on a case by case basis and/or under individual solid waste management permits.
