Current Regulations Governing Coal Combustion By-Products - Minnesota

Under Minnesota regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated from the combustion of fuel which is at least 51% coal or other fossil fuels and the balance of the fuel does not contain hazardous waste is exempt from regulation as hazardous waste. Reuse of CCBs is not specifically authorized under Minnesota law or regulations. Permits authorizing CCB use for soil stabilization and agricultural amendment may be issued in 1998.

Detailed Review of CCB Regulations:
Under Minnesota regulations, fly ash, bottom ash, slag and flue gas emission control waste generated from the combustion of fuel which is at least 51% coal or other fossil fuel and the balance of the fuel does not contain hazardous waste, is exempt from regulation as hazardous waste. MINN. R. 7045.0120(1)(F). Currently, reuse of CCPs is not specifically authorized under Minnesota law or regulations.
Utilization of CCPs is approved on a case by case basis. According to the Minnesota Pollution Control Agency, the state is currently in the process of developing a policy for handling and approving utilization of industrial byproduct requests.
