Current Regulations Governing Coal Combustion By-Products - Louisiana
Louisiana
Under Louisiana regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated solely from the combustion of coal, or other fossil fuels, are exempt from regulation as a hazardous waste. These materials are, however, regulated as industrial solid wastes. Reuse of CCBs is not specifically authorized under Louisiana law. Specific applications for reuse must be approved by the Louisiana Department of Environmental Quality.

Detailed Review of CCB Regulations:
Under Louisiana regulations, fly ash, bottom ash, slag and flue gas emission control waste generated solely from the combustion of coal, or other fossil fuels are exempt from regulation as hazardous waste. LAC 33:V.105(D)(2)(d). These materials are, however, regulated as industrial solid wastes. LAC 33:VII.115 (ERM LA115). Currently, reuse of CCPs is not specifically authorized under Louisiana law or regulations. Specific applications for reuse must be approved by the Louisiana Department of Environmental Quality.
