Current Regulations Governing Coal Combustion By-Products - Idaho

Idaho regulations adopt by reference the federal regulation that exempts CCBs (including fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal) from classification as hazardous waste. CCBs are regulated as industrial solid waste. Reuse of CCBs is not specifically authorized under Idaho law.

Detailed Review of CCB Regulations:
Idaho regulations adopt by reference the federal regulation which exempts CCPs from classification as hazardous waste. Exempt from hazardous waste regulation are fly ash, bottom ash, slag and flue gas emission control waste generated primarily from the combustion of coal. IDAPA 16.01.05.005; 40 CFR 261.4. CCPs are regulated as industrial solid waste. IDAHO CODE §39-7403(22), IDAPA 16.01.6. Currently, reuse of CCPs is not specifically authorized under Idaho law or regulations.
