Under Florida regulations, fly ash, bottom ash, slag, and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste. Reuse of CCBs is not specifically authorized under Florida law.

Detailed Review of CCB Regulations:
Florida regulations adopt the federal regulations which exempt fly ash, bottom ash, slag and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels from regulation as hazardous waste. FAC 62-730.030. CCPs are regulated as solid waste if disposed of (FAC 62-701) and may be regulated as industrial byproducts if the CCPs are utilized within one year, if there is no release or threat of release into the environment, and if the facility is registered with the Department of Environmental Protection to allow for such recovery of CCPs.
Ash residue from CCPs for use in concrete is specifically authorized under Florida law. FLA. STAT. 336.044
