California
Under California law, fly ash and bottom ash are presumed to be hazardous waste unless ash satisfies certain testing requirements and does not exhibit a characteristic of hazardous waste. Fly ash and bottom ash which contain metals at certain levels have been prohibited from land disposal since 1 Jan 1991. Ash from the combustion of fossil fuels may be classified and managed as a special waste following Department approval of an application for such classification. Special waste may be disposed of in non-hazardous waste landfills under certain conditions. Reuse of CCBs is not specifically authorized under California law or regulations.
