Fly ash, bottom ash, boiler slag, and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous or industrial solid waste. According to the Alabama Department of Environmental Management (DEM), fly ash, bottom ash, boiler slag, or flue gas emission control waste that result from the combustion of coal at electric generating plants are not regulated wastes. Fly ash and bottom ash may be considered special wastes that require specific handling. Reuse of CCBs is not specifically authorized under AL state law, but may be authorized pursuant to the reported DEM interpretation of CCBs and non-regulated solid wastes.

Detailed Review of CCB Regulations:
Under Alabama regulations, fly ash, bottom ash, slag and flue gas emission control waste generated primarily from the combustion of coal or other fossil fuels are exempt from regulation as hazardous waste or industrial solid waste. ALA.ADMIN.CODE R.335-13-1-.03(12) and (63); 335-14-2-.01(4)(b)(4). According to the Alabama Department of Environmental Management ("DEM"), fly ash, bottom ash, boiler slag or flue gas emission control waste which result from the combustion of coal at electric generating plants are not regulated wastes pursuant to ALA.CODE §22-27-3. However, under ALA.ADMIN.CODE R.335-13-1-.03(134) fly ash and bottom ash may be considered special wastes which require specific processing, handling or disposal techniques.

Currently, reuse of CCPs is not specifically authorized under Alabama law or regulations. Nevertheless, CCP reuse may be authorized pursuant to the reported DEM interpretation of CCPs as non-regulated solid wastes. ALA.ADMIN.CODE R.335-13-1-.03.
